Seller Agreement
Welcome to Drag Queen Market!
This Seller Agreement governs your access to and use of our platform as an independent third-party Vendor ("Seller").
By registering an account or listing products on dragqueenmarket.com, you agree to be bound by this Agreement. If you do not agree, you must immediately cease using the platform.
1. Account Registration & Conduct
Eligibility: Users must be at least 18 years old or the legal age of majority in their jurisdiction.
Account Security: You are responsible for keeping your login credentials confidential and for all activities that occur under your account.
Single Account Rule: To ensure marketplace integrity, Sellers are restricted to one active account unless granted explicit written permission by Drag Queen Market.
Prohibited Conduct: Users may not engage in data scraping, use bots, manipulate search and sales metrics, or communicate off-platform to circumvent transaction fees.
2. Marketplace Vendor Rules & Compliance
Independent Parties: Sellers operate as completely independent businesses. Drag Queen Market is not a party to the contract of sale, does not employ Sellers, and is not responsible for Seller inventory.
Listing Accuracy: Sellers must provide accurate, clear, and up-to-date descriptions, pricing, shipping costs, and image assets for all listed items.
Legal & Safety Compliance: Sellers guarantee that all items sold comply with US federal, state, and local safety, manufacturing, and consumer protection laws.
Product Safety: Sellers assume full responsibility for any defects, nonconformities, or product safety recalls associated with their items.
Seller Information & Verification: Sellers must provide accurate, complete, and up-to-date information during registration and throughout their use of Drag Queen Market. Drag Queen Market may request additional information or documentation at any time to verify a Seller’s identity, business activity, brand ownership, product authenticity, tax information, payment details, or compliance with this Agreement. Failure to provide requested information, or the submission of false, misleading, incomplete, or unverifiable information, may result in the rejection of the Seller application, suspension or termination of the Seller account, removal of product listings, cancellation of orders, withholding of payouts, or any other action Drag Queen Market deems necessary to protect customers, other Sellers, and the marketplace.
Dropshipping: Drag Queen Market champions stores that physically own their stock and take their own pictures for Drag Queen Market. We do not support the dropshipping business model. If a seller is thought to be running their business as a dropshipper, then Drag Queen Market, at its own discretion, may remove that seller’s account(s) from the site without notice or prior warning to the seller and shall take any measures it deems necessary to ensure that subsequent dropshipping accounts are not opened on the Site.
3. Pricing, Fees, and Payouts
Platform Fees and Product Pricing: Drag Queen Market is free to join. Sellers do not pay any monthly subscription fee, setup fee, listing fee, or fixed product fee to sell on the marketplace.
Sellers set their original product price. Drag Queen Market then applies an automatic customer-facing price adjustment to include the marketplace commission in the final price paid by the customer.
Drag Queen Market’s standard marketplace commission is 20% of the final customer-facing product price, excluding taxes, shipping charges, return shipping costs, and any other charges that are not part of the product price.
This means the marketplace commission is built into the price paid by the customer. After Drag Queen Market’s commission is deducted, the Seller is intended to receive their original product price, subject to any refunds, chargebacks, disputes, adjustments, or other deductions permitted under this Agreement.
Sellers are responsible for reviewing and confirming their original product prices before publishing their listings on Drag Queen Market.
Payout Schedule: Earnings are distributed to Sellers every month via Stripe or PayPal for orders successfully delivered and marked clear of active disputes.
Transaction Safeguards: Drag Queen Market reserves the right to establish transaction limits, delay payouts, deduct applicable amounts, or temporarily withhold funds to mitigate risks associated with refunds, returns, high return rates, fraud, suspected fraud, chargebacks, customer disputes, Seller disputes, payment processing issues, or other marketplace risks.
4. Intellectual Property Rights
Our Content: Drag Queen Market retains all rights, titles, and interests in the website's design, code, logos, trademarks, and branding.
Your Materials: Sellers grant Drag Queen Market a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, modify, and display their product descriptions, images, and brand assets for promotional purposes.
IP Infringement: We strictly prohibit selling counterfeit goods or using unauthorized copyrighted or trademarked materials. Infringing content will be removed immediately upon notice.
5. Customer Communications & Reviews
Internal Messaging Only: Sellers must strictly utilize the provided on-platform messaging tool for all customer communication. Direct emails, phone calls, or unsolicited marketing are banned.
Review Integrity: Artificially inflating, falsifying, or manipulating customer reviews through financial incentives, threats, or fake accounts is strictly prohibited and will result in permanent account termination.
6. Returns, Refunds, and Disputes
Seller Return Policies: Sellers must comply with Drag Queen Market Return Policies.
Marketplace Intervention: If a customer files a dispute and the Seller fails to respond or provide a resolution within 48 hours, Drag Queen Market reserves the right to issue a refund directly to the buyer and charge the Seller's account balance.
7. Indemnification & Limitation of Liability
Seller Indemnity: Sellers agree to defend, indemnify, and hold harmless Drag Queen Market, its officers, and employees against any third-party claims, legal losses, damages, product liability issues, or tax obligations arising from their inventory or policy violations.
Limitation of Liability: Drag Queen Market provides this platform on an "as-is" and "as-available" basis. We are not liable for lost profits, server downtime, business interruptions, or indirect damages resulting from your use of dragqueenmarket.com.
8. Termination
Termination by Us: We reserve the right to suspend or permanently terminate any user account at our sole discretion, without prior notice, for structural policy violations, fraudulent actions, or behavior that damages the marketplace community.
Termination by You: You may close your account at any time by contacting support, provided all pending orders have been fulfilled and resolved.
9. Governing Law & Dispute Resolution
Governing Law: This Agreement is governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
Arbitration: Any legal dispute arising out of this agreement will be settled through binding, individual arbitration in Wilmington, Delaware, rather than in a court of law.
